My husband & I are through. I can no longer put up with the emotional abuse. I have a much better job than he does and don't want to move. I have asked him to leave. He refuses. I can't afford to move, and have no where else to go. I really need some good advice.

First of all change the damn locks it doesnt take very long or call the police they will make him leave. Honestly emotional abuse is abuse no matter which way you put it. So call the cops it is in your best interest. I live in illinois and Just recently there was a situation of a husband and wife the wife told him she was leaving him and she wanted a divorce he took there kid and killed the child and then was on the run for 3 days they found him in a barn he hung himself. So before it is too late get help before he snaps. My husband left me and took my car, money, cell, and child. I was stuck in the middle of the country with nothing. no way to leave, no way to pay for anything, no way to call any one. Finally soemone from work came out to see if i was ok they had heard what happened. Men are cruel, woman can be too. but when they are hurt they want you to hurt. Get out while you can and if i had it to do over again i wouldve called the police.

Change the locks, put his stuff outside in nice neat garbage bags, pick up a Uhaul (have a friend drive your car home and park it a few blocks away so he thinks your not home and willnot bother knocking on the door. He'll have no reason to come in at all and then arrange to stay in a hotel for the night. If you can take off work so he won't come to you job acting crazy. Don't answer your phone, once ready to move ahead with your divorce let all contact go through your lawyer.

Give him a 30 day eviction notice. Tell him that fater that he either move his stufff or you will get it move out for him.

Pack his stuff leave it at the door and change the locks. On the door leave him a note saying that you wish not to be harrased or stalked and that if he persists, you will get a restraining order. Tell him that any communication should be through your lawyer.

That will keep him away.

Its a hard question you have asked! Especially because us outsiders do not know more detail and the circumstances! You will have to check legally whom the appartment "belongs" to or who the main tenant is. If the tenancy agreement is under your name then he has to go out! However, first, get the divorce through because you cannot, legally, throw out your husband if he has not physically attacked or abused you! Good luck!

Seek legal help. If you have that much of a better job, why can't you afford to move?

Listen, if you are ready to move and he wants to stay. Set a time table. You have to leave..... and I have to leave..... Get your affairs in order and slowly shut off bills to gain a surplus of funds. This may take time so stay as busy as possible. Go out with friends and stay over their houses if they don't mind. Make your stance clear. When he sees that you have moved on he will move on too.

To be honest, short of filing for a divorce, you can't make him leave. He has a right to be in any dwelling with your name on it. I am not sure of your state laws, but there are a few loop holes in this. Check with an attorney, Then follow that advise.

Yes you have to file for the divorce he cannot refuse to leave the house if you dont want him there anymore specially if you have kids together the laws will be in your favor

who cares what HE wants ?! file for divorce, get a restraining order and no matter what take some money and get the hell out. he nor the place you live is worth the pain and suffering, it would be much better to have it financially tight for a couple of months than stay..

As long as the house is your name, you could kick his a$$ out.
If not, you could buy his portion of the house. Or get a divorce and tell the judge that all you want is the house and nothing else.
