You can petition the courts for a modification of child custody. PRO SE.....I would suggest you get a PARALEGAL to prepare the documents for you!

Without an attorney you'll be a fish out of water! I'm sorry but child custody issues are expensive, lenghthy and complicated!
How on earth did you get yourself into this situation in the 1st place?

Using the excuse you can't afford is LOSER mentality!!!!! Borrow from a 401 k.....take out a loan......max out your credit cards.....if you are really serious about getting custody there should be NOTHING that would stand in your way.

Talk to a good family law attorney------seek counsel and information....maybe they can work out something financially for you too....like a payment plan or wage assignment to pay the legal fees.....Go that extra mile....If you sit back and use the poor me pity party---I can't afford it routine....your children will remain with whom has custody!!

Act on your own behalf. I have done this with success. You need to find out the proper paperwork to lodge in court and than file the relative affidavits to accompany the paperwork. You can download the necessary paperwork from the net by logging onto the courts. A lot of people are doing it these days and with success also.

Call family court and tell them you want to file a petition for custody. You then will have to go to court and speak with intake person and answer petition questions. They will then mail you petition and have you have someone serve it to person you want to gain custody from. The local police will do it for a small charge and then you go to court on the given date and explain the situation to the judge.

A few questions first...who has custody of them now? Do you have visitation? why or why not? This all makes a difference on whether you "should" go it alone.

You can go to the courthouse in your area, fill out paper work, and go before a judge. Good luck.
