Ask the politicians. They decide what's legal and not. Us common folk can't do much about it.

Alcohol is legal because our forefathers drank it themselves.
They did not, as it turned out, smoke the green stuff.
So it was all a matter of location, location, location. We settled in the upper east side, not the lower west side - where the green stuff was initially supplied to low-level Americans during the pioneering years of the nation.
Racial matters got the most of the nation (Mexicans were importing this stuff, so Mexicans were clearly demonized), and beer, although today a very dangerous drug and the cause of many deaths, happens to have a long-standing tradition within our own history that to not drink is considered uncool, antisocial, and antihuman.
Think about it: they tell you, "c'mon, man, drink. Be a little human, please!"
Clearly, our own history set us on this path.
Socially acceptable? Even for the high priests (wine). So the trickle trickles down the poverty stricken slumps.

They were both made illegal at he same time but Alcohol was made legal to reduce organized crime and tax a product that seems to sell itself. Drugs tend to be sold once and then the person gets baked and passes out. Alcohol tends to be sold time and time again and people get drunk throw up and drink even more before the pass out. Can you see the benefit of taxing alcohol as opposed to drugs. And here's a thought drugs take away from the already taxable liquor and pharmaceutical markets. So it only makes good business sence to keep drugs illegal.

Because when prohibition was tried a long time ago, it didn't work. People self-medicate with alcohol and it helps them to relax. Caffeine is also a legal drug, as is nicotine.
