yes. she has to go through the courts to let him know she is moving. Also, does she really want to do that? I mean, if he has visitation now, it can complicate things. If the state is going to be close to the state in which he lives, the courts usually will make the person who has custody and moved away, drive the child there and back for the visits. If the state in which the child will reside is not close to the state in which the father lives and he has visitation, the mother will get the child during the winter, and the father will get the child during the summer as soon as school is out.

Are you talking about parental rights? If the father isn't listed on the birth certificate she can do whatever she likes as the father cannot make claim until paternity tests are run.

If he is the father, if he hasn't signed over full custody and is maintaining his rights as a father then she needs to let him know she is moving and organise an intervention order against him that prevents him from being near her but allows visitation.

Do you want to adopt your girlfriend's son? It'll be tricky because you are only recognised as girlfriend and boyfriend - however if you've been together for over a year (this may differ in the US - I'm in Australia) you're recognised as a legal couple and as such you can have more rights in terms of the child and your relationship to the child.

Also does the father pay maintenance? If he does then chances are that he's legally recognised as the father and this can affect your rights and your girlfriends rights.

I hope this helps somewhat.
