I’m inclined to think that the act of ‘sexual assault’ commenced the moment she let him know she didn’t want him to continue doing what he was doing.
I suspect that she has to go from being a ‘consenting adult’ to a ‘victim’ before it is deemed to be a sexual assault…
Here is a scenario to consider…
He and she meet up at a night club.
They have a few drinks, and dance together. (She is a consenting adult)…
They kiss (She is a consenting adult)…
He starts fondling her (She is a consenting adult)…
She objects, but he continues (She is no longer a consenting adult… He is sexually assaulting her).
My interpretation may be wrong, but I don’t think so !!!
If there were witnesses to the fact that he continued to assault her after she told him to stop… she would have a good case in court!
You never mentioned how old the girl is…
If she is younger than the ‘age of consent’…
Then the ‘sexual assault’ commenced the moment he touched her !!!
Suggest to your friend that she talks to a counsellor or a doctor.
If there is a Rape Crisis Centre in your area… she should contact them as well !!!

Insertion of any body part into the body part of another without their consent is RAPE. The law is very clear about rape and what constitutes groping. Groping is touching a person externally against their will and rape is the insertion of anything into another person without their consent. It most definitely was a rape if she said NO and it continued. It must be made clear to the person making the advance that the behavior is an un-wanted act. Hope this info helps..........good luck !

It was definately a sexual assault and he could be arrested because he put his hands on her,it's just the same as physical abuse.It would be called a rape if he had penetrated her but what he's done is definately a sexual assault.She needs to tell the police immediately.

Well I'm not 100% sure of the legal definition but I'm thinking it would either be "gross sexual assault" or "rape". As far as does she have a case? I'm not a lawyer, but she DEFINITELY should seek legal advice and file a police report. Best of wishes to your friend, it's a hard thing to go through.

I would suggest that your friend contact the rape crisis center or authorities in her area to me sure. I don't think it's rape. But it's definitely assault... Tell your friend to be brave and strong don't let this guy get away with this. I am sure he has done this before....

Absolutly, its assault and rape!!!! Just because she froze, doesn't mena she was giving consent. I do not know how far a case will go, there would need to be eveidence, otherwise, its just he-said/she-said, but definitly file chanrges.

That is rape. she needs to call the police and go to a hospital to get examined. That is crucial to proving that you actually were raped when it goes to court.
