I'm looking for a percentage here.
What are the chances that the person is smoking a drug (i.e. marijuana, hash, crack...)....AS OPPOSED TO smoking legal pipe tobacco?

If it's a glass pipe,there's no question as to it's contents.I know people on drugs or even drinking do some VERY dumb things,but I would hope that if it's a person in public,that they would have more sense than to smoke dope out of a pipe in public.So, I'm going to say in public a pipe smoker would be smoking tobacco.HOWEVER I WOULD NOT BE SURPRISED OTHERWISE.
So, I'm going to go with 70/30,on the side of it being tobacco in public.But then again, it would all depend on where your at.If it's at a MegaDeath concert,I'm going to have to go with 100% dope.
