if you have the CD you can just copy it, no need to download. if you CD is damaged, then yes go ahead and download, you have have already paid for it.

I would assume that because downloading a particular music track for free is generally illegal, nobody cares if you have fifty of the cd's in your case. The law doesn't usually get involved in individual circumstances. There are laws. They say something is illegal. They don't look beyond that. You may know that you aren't getting something you don't already have, but the law doesn't know or care about that. (I'm pretty sure I'm correct on this.)
If the law says that the act of downloading something is illegal, regardless of the fact that the law was considering artists' rights to money for their work the fact is it is the act of downloading that is illegal. The law can't get involved beyond that.
(I'm seeing some other answers on here and wondering if I'm not correct. You may want to reserve judgment on which answer to believe until you have a lot more answers from a lot more places.)

If you own the cd you paid copyrights to listen to it. Why download it when you can use Windows media player to rip the song and get a better quality?

You can UPLOAD the CD into your computer. In most cases you can not share that song legally.
