I really don't think thats legal. How could you stop someone from a natural body function? But check this out from Employeeissues.com:

"Although there are no Federal and few state laws that require employers to give bathroom breaks, the Federal Occupational Safety & Health Administration (OSHA) has interpreted a section in its Sanitation Standard, to mean that it "...requires employers to make toilet facilities available so that employees can use them when they need to do so. The employer may not impose unreasonable restrictions on employee use of the facilities." OSHA further clarified this interpretation in a letter dated April 23, 2003. Additionally, one of OSHA's Safety and Health Guides recommends that "Additional break periods and meals should be provided when shifts are extended past normal work periods.""

So, its not spelled out, but according to OSHA, you should be allowed to use the restroom faclities. A lot depends on your state--I live in Illinois and the laws are more strict here than in other states.

This is illegal...shame on the company, but also, shame on the employees who don't stand up for themselves!

Why would the employees put up with this??? Why wouldn't they just walk out and take the break they are legally entitled to? Employers will continue to dish out whatever BS their employees will take until someone stands up to them!
