He may be dead now but he can definitely come back. Space-time is a great tool for bring anyone dead or alive to different places or time.

Technically, it's up to the writers to decide whether or not to revive the character. But, since there is no talk of continuing with the Next Generation/Voyager/DS9 storylines officially, then your guess is as good as anyone else's.

For the record, Data's body was completely blown to bits at the end of Nemesis, but he had downloaded part of his memory into B4, to help it grow. At the end of the film, B4 was singing a song Data was before they met, so....

I had answered this question once before with --
"according to starfleet records you are alive" this was said to data in one of the episodes in season 2, so yes he is alive.
-- but everyone eles is answering that he isn't. There is another episode were there is a "trial" to see if data is alive, as I recal it was inconclusive so I am going to stick with what I heard in the other episode and say he is alive.

in the movie nemesis, he was destroyed on the romulan ship trying to destroy a "thalaron beam generator". there was a farewell speach that the character Picard gives about data.

there is also the fact that the actor Brent Spiner has said he will no longer play the character. so Data is essentially dead.

The physical Data was destroyed, but his positronic brain was downloaded to the other model before he was destroyed. So, his shell is destroyed but his mind is alive.

If I remember correctly, there are a couple of episodes which deal with this, and the conclusion is always something along the lines of "This is a complicated problem which requires additional consideration."
