my bfs son lives with his ex and his ex is about to lose him to department of children and families his ex signed over temp custody to her mom how does my bf intervene? should he contact dcf? let them know he is willing to take him?

she signed it to her mother through a notary in florida nota court and he is a part of his life he pays childsupport he has him every weekend and wednesdays and whenever his ex asks him 2 take him...

he is the legal father and the grandmother barely sees him and she is not in any condition to take care of him especially when she is also taking on the exs other 2 children ages 1 and 4 weeks his son is 6 the other 2 arent his just the 6 yr old and dna proved that. there is no problems to be started or added to its just that the grandmother has multiple schrosis and just had a stroke a month ago and we feel she is not stable enuff.

if he is the blood father and has proof there should be NO problem of taking the child...... he is the next legal quardian of the child...... he needs to talk to a lawyer and fast, there is no other recourse, but once the child is in the system it may take longer and will be much harder...... if there is no proof of parentage the man needs to get DNA testing done also..... gotta have the proof in court......... so i bid you good luck and Gods spead and I pray it all works out for the little one.......... This doesn't sound right. If your b/f is an involved part of his sons life I can not see how the ex could have signed custody over without his permission. The best thing to do is contact an attorney for these issues some do offer free consultation...this is a legal question where you will be getting opinions...although some good answers will have experience in this type of situation...each state, county and court make different choices per family focusing on the child's best interest. Find a family attorney and see if they can do a free counsiltation.

well for one thing has your b/f been there caring for his son in the way of visits and child support?if so then he could contact dcf and ask them what steps he needs to take to have his son but if this child has had little to nothing to do with him at this point when there seems to be some problems already why add to the childs worry by coming in and taking him from his grandma if he has been a dad up to this point then i am sure the grandmother will be more then happy to let the child see him i would think at this point when dcf is getting involved its time to let the child be somewhere he feels safe and secure and not pick this time to start another problem

Yes, because they always make an effort to place the children with a family member and a biological parent will usually get first choice.
