My sister had a baby with someone who is legally married to another woman except they don't associate anymore and he does not know where she is located. However, since he couldnt hold a job for the last 2 years, she left him with their 1 yr old daughter. both of their names are on the birth certificate and they live in georgia. Who has the keep the daughter if there is no court order? The mother is planning on moving outter state to live with her parents. Is it legal? ADVISE PLEASE. SERIOUS ANSWERS ONLY!

Both parents don't work. My sister babysits my kids and have more than enough money to care for her daughter. The father is unstable and cannot hold a job either.

umm..if it confused u, i'm sorrie. Even tho the father is legally married to someone, he has no idea where the wife is... after that, he was with my sister for the last 2 years.

Child custody and guardianship are legal terms which are sometimes used to describe the legal and practical relationship between a parent and his or her child, such as the right of the parent to make decisions for the child, and the parent's duty to care for the child. I suggest that she contact legal aid society and obtain guardianship of her doughier before moving out of state. Court do not look favorable when parents moves child to different jurisdiction and your sister will be forced later to appear before the Giorgia Family Court.

In Ohio if you were not married the mother has legal custody unless she isn't fit or stable. but it is also stated that the mother must get the OK from the father to move the child out of state.

As long as the mother can prove the child is taken care of the mother has the rights. unless however the father decides to go thru a custody battle then its up to the judge. Im in a similar situation so if you want to talk about this in depth write me at leaves_of_autumn171311@yahoo.com

Usually the child stays with the mom but that isnt always true. I had a friend who was sort of in the same situation (he wasnt married though) and he filed for join custody before she could move. She moved anyway but had to send the child back to him for half the year

I am not sure of the state of Georgia but in the state of Ohio the first one to file papers wins.

has anyone gone to the courts to GET CUSTODY?

i know that in a commonwealth state (not too sure about others) no one has custody until someone goes to the courts to GET IT.

so your sister gave her ex her kid or the wife gave him the kid? i'm confused.
