Hello everyone,

I am looking for a little help on a matter. My employer mistakenly over reimbursed me for moneys related to parking. From Jan to June I had pretax money withdrawn for parking on each paycheck. Every other paycheck I had an addition of reimbursable for the parking. After the end of June, the deductions stopped, but the reimburses continued. Does my employer now have a right to deduct this money from my paycheck to reclaim it?

I didn't know this was happening, my employer brought it to my attention. This all happened along with a pay raise, so I didn't think anything of it, just an increase in pay.

yes, actually they have a right to demand payment at once, so they are being nice letting you pay it over several weeks, they could merely ask for you to write them a check

Of course. It was money given to you, that you didnt earn. If the situation was reversed I'm sure you'd be looking to get the money you were underpaid. So, naturally he will look to collect. However, because a check is a pay order and he has already issued you a check for that amount it might be tricky but I'm sure if he brought it to a court they would be able to tell what was legally yours and what was an error. . . .

I live in Iowa and I ran an office for 2 years, doing payroll among many other things. Yes, if we over paid an employee we would deduct it from one of the future checks. It is just as much your responsiblity to alert an employer for over payment as it is under payment.

I would say yes. You did not earn this additional benefit, so your employer would have the right to deduct it. I would bring it to your employer's attention immediately, if they don't already know, and ask if this is correct. Your employer will no doubt appreciate your honesty in the matter.

Yes your employer has every right to do so. And it was your responsibility to tell your employer about this oversight on his / her part for the reimbursements. That's grounds for dismissal from your company.

Yes, your employer does have a right to take those funds back, either thru your paycheck, or just have you write a check to them for the amt. It sucks, but you really aren't supposed to get the funds, so you have to give them back.

Yes they have a right to reclaim it. And you have the responsiblity to report it to your employeer as well. Even though it is their mistake, it can be regarded as stealing from your company.

You knew at the time you were being overpaid, hate to tell you but yes he can. Any overpayment can be taken out of your check, if you feel your being cheated call the Labor Relations Board., report him they'll tell you if your right or wrong.

Of course, do you have a right to collect for underpayment of your paycheck?

Bring it to their attention. If you knowingly receive more money than you should you can be held CRIMINALLY liable.

Yes I know someone who had a particular situation and yeas then can take the $ back.
