All monies are to be turned in, cash or otherwise! If he doesn't turn in the cash, he's guilty of tax fraud. Let your attorney know his situation.

I have had this same problem when I went through my divorce. My ex husband worked under the table 90% of the time and did not claim it for child support. He is suppose to claim this for tax purposes etc...but most of the time this does not happen. You will have to prove it to the courts that he is making money under the table. A good way to go is to higher a private investigator if cost permits. You also need to consider what you are making if you are working because it will be a factor...another thing is to possibly work it out with your soon to be ex if he is willing....let him do his own thing by working under the table and take his chances at getting caught....just ask him if he can help contribute with the children's additional needs outside of child support if it is needed such as diapers, clothes, school supplies. A lot of times in this day and age the fathers are willing to play this active role. Most importantly contact an attorney and tell them everything even if you are afraid of making your ex look bad...the attorney can not help you completely unless they are fully aware of the whole situation. Most likely he wont report it so you can give up all the information you know about the place he works. Most likely the judge is going to require he prove where he works and how much he makes but cases without paychecks can be difficult.

yes everything is suppose to be declared. Of course he could say that he is no longer going to do that work. He was suppose to declare that on his income tax return. Think before you bring this up, because if you have been filing joint tax report you are just as guilty. something to think about.

He is supposed to fill out a court financial report. If you can obtain written evidence to support his cash income it can be turned in to the court in case he "forgets" to put it down on his statement.

Yes, he's supposed to include it. It's income.
He's supposed to pay taxes on it as well.
