and all the evidence says that they did, but, they insist they didn't , would you believe the evidence or the person?

If they can't contradict the evidence against them then you don't really have much choice. If they can come up with a reasonable explanation then take their word for it. Evidence can sometimes be misinterpreted or completely false.

I would believe the evidence. People can lie.

I would first ask the person how they reconcile their protest of innocence with the incriminating evidence -- I'm willing to believe anything you can prove!
