He is a very old man and cannot run from court to court the tenants are trying to take advantage of his situation. The property is in a prime location. Few of the tenants are reporters and so no one is willing to co-operate. He has requested several times to vacate but no results. Please advice a legal way to resolving this situation . What are his options?

Follow your local laws and file an eviction. Pay close attention to written notices and the time periods necessary. Once the notices are filed and the tenant doesn't pay, DO NOT ACCEPT partial rent payments from them. Tell them, to save the money for their next rental property. Good Luck!

An attorney familiar with evictions and landlord rights should be able to quickly resolve the problem. In the meantime, he could contact a handyman to go to the property and remove all the doors. I'm serious. Have the handyman take the doors. If asked what he is doing, have him say, "I've been hired to make repairs on these doors. I should have them back in a few weeks." The tenants will not want their stuff stolen like they are stealing from your grandfather so they will have to have someone stand guard or move out. A friend of mine in Minneapolis did this. The tenants called the cops and when the cops found out the tenants were behind on rent, they just smiled and told the tenants the landlord was just making repairs on the property. How could they complain? The tenants moved out the next day.

His only option is to go to court. There is no reason he should have to "run from court to court." I have no idea what you mean by "few of the tenants are reporters and so no one is willing to cooperate."

He needs to see a good eviction lawyer ( called summary process in MA and by other terms in other states). If he is too old to run to court, he could walk or ride. He could grant someone a power of attorney to handle the evictions, or even to manage the property generally. Of course, if he has no one he can trust to do that without ripping him off, he has a more serious problem than tenants.

He may wish to hire a property manager to handle the business affairs for him. Does he only have one rental property? We may also want to consider selling the place and then invest the money into an account for a safe income. Wouldn't it make more sense to have $100,000 or whatever in the bank collecting interest for the next 10, 20 or 40 years than collecting rent (or not collecting it) and tying up that cash??? If he cannot take care of the property and problems, it may be time to bail out. Why don't you buy the place from him???

Unfortunately, I think that your grandpa will have to take them to court, but since he is an elderly man, you should become his power of attorney. From there, you could go to court and serve them with an order of eviction, and give them thirty days to vacate the property. If they still do not leave, have them escorted by the police to leave. I am sorry but this is the only way to get them to leave. I also think that you should sue for back rent, or keep the security deposit.

Take him to the sheriffs office to file an eviction notice and ask the sheriff to serve it. Tenants have rights unfortunately, and I'm sure your state has a procedure to follow to have someone removed from your property. This is a situation where you will need to help your grandfather all you can.

If he has an agreement done at the time of renting there should not be any problem at all. As per the norms of the agreement they have to vacate as per the duration mentioned in the agreement otherwise he can contact the police .we went through a similar situation but was solved by the police intervention though it does not come under the police jurisdiction.

You need to check with your local municipalities like the city government to find out about evictions. Assuming they have been there without a lease and have not been paying rent, your issue might be as simple as calling the police too.
