The answer is probably yes.....and other marriages don't matter it is who you were married to the longest. My mother in law draws her SS on her first husband because they were married 21 years and she was married and divorced twice after that. But she also does not draw but a spouses amount, until he passes away. So if you have worked it may be better to draw on your own and receive more.

Gee.... GO ERA....GO Equal Rights....GO Equality of the Sexes..........

And why is it so many older women wonder why men their age don't care to re-marry? I was married to a wonderful woman for 20 years. She has remarried a great guy and I wish her the best. But I have very little interest in remarrying even at the relatively young age of 52...I've been single for 7 years.

My ex is now 50 and has been married for about 4 years. I have little doubt she will be married long after I start to receive any SS benefits.

It replaced right into a huge mistake to get married to somebody who made it sparkling earlier that he did no longer choose that. Marriage is tough adequate whilst the two events bounce into it willingly. And to purpose and sneak this guy right into a toddler with you replaced into previous incorrect. Do you already know thats yet another life comittment for the two one in each of you? Its in no way a humorous tale. You sound egocentric and annoying. Your huge project is which you had a huge wedding ceremony. Do your self and this guy a choose and grant him the divorce. no use dropping a while on some thing that could desire to have never been in the 1st place.

I believe if your ex husband wasent ordered by the courts to pay you any type of spousal maitenace then your not en tilted to any of his social security, but you may want to check it out at the court house and the social security office in your state.

what it is...they base the amount that you receive each month on the largest benefit...yours or his.
it's not really a part of his just a basis of the decision
and you have to have been married for 10 yrs

I've read that you can get 1/2 of his. Get a good lawyer if you have to.
