Okay, here's the deal... I had a c-section when my son was born. Sometime later I developed a mass in my abdomen near the scar and it's incredibly painful! I finally received a "diagnosis" and the doctor is quite confident that it is an endometrioma and it's there because the doctor that delivered my son, sewed my part of my uterus into the lining of my stomach muscle when he was "closing" me up. (I still have to have corrective surgery to confirm the diagnosis.) If, in fact, this is what happened, I am going to proceed with a malpractice suit. Any ideas as to what is involved, how long it takes, is it worth it, and how much might I expect to get?

Depends on the lawyer and the flow of the trial. Maybe, it will take one (1) year for the court to make the final decision. The cost of litigation depends again on the amount of your claim. The higher the claim, the higher the fees will be but this is affordable. You can claim as much as you can because the damage done to you is even not quantifiable.

Well I had a hip replacement at age 32 from a baseball injury. It fell apart 6 years later and I let the original doctor at Johns Hopkins do the revision. That fell apart 4 years later. Found out that mal practice has to be filed within 2 years of a problem. On top of that mal practice lawyers get a pretty much standard of 75 to 80 per cent of the award plus expenses. Call a couple from the phone book and I think you'll see that I'm not kidding. I guess it's up to you if you think it's worth it but in my case I just thought it wasn't worth all my effort ,time, and heartache to give all the money to the lawyers. I just accepted that I was wronged by the doctor and he is human and can fail. Although it has put me through alot of pain and changed my life in alot of ways at least I am alive and maybe there was a purpose for it to happen. I really feel for you and wish you luck, but try to look at anything positive that came from the operation. It may take awhile but I'm sure you can.

Medical malpractice cases are among tbe most difficult and expensive to pursue. Many states have very short statutes of limitation and investigative and notice pre-conditions for filing such suits. Get a recommendation to a local mal-practice attorney as soon as possible. If you have an "iffy" case or one without massive damages you may be asked to pay for obtaining the medical records.
