me and partner tried to get a car on finance but couldnt so my mum got us the car on finance in her name but the money comes out of my bank account but the log book is registered in my partners name now he has left me coz he has feelings for someone else but doesnt know who he wants, so i took the car off him and now he wants it back and said he was going to the garage where we got it from so he can get it back! but my mum and i want to give it back to the finance company... can we do this? and does he have every right to get the car back?

Your mother has absolutely every legal right in the world to cancel. It will cost a bit for admin but your partner has not one jot of legal right of ownership.

The name on the vehicle registration indicates who is the registered keeper of the vehicle, not the owner, although in most cases its the same.

assuming that you mean its financed by HP then the vehicle is owned by the finance company, and they will look to your mother to settle any amount outstanding.

he has no rights to the car, unless there is some divorce or legal separation agreement and the car is part of that (which is unlikely).

if he wants the car that much get him to make on offer for it (ideally you'd want him to buy out the lease from the finance company if such a thing is possible) so that you dont have to make any more payments, and your mothers credit is not adversely affected by anything your ex may choose to do..

the options are to either find out form the finance comapny what the remaining balance is (ie how much cash would they take to go away), compare that to the sales value of the car. if its cheaper to give it back to the fiannce company do that, otherwise consider selling it.

if he can persaude the garage you return it to to give it to him good luck to him, its not your concern.

Legally it looks like your boyfriends as the log books has is name on it, but the finance is in your mums name, which means by financial law its your mothers. If two years or half of the finance has been paid, then you can send the car back to the finance compnay. The garage can't do a thing for your ex, they just sell the product, its all down to the finance company. I would phone the finance company, just make sure what your standing is on the matter. Don't do anything until you speak to them, as its still their car by law. They need to be notified of any changes.

If the finance is in your mum's name then it's legally her car... as havig his name on the logbook will only make him the registered KEEPER and not owner. The garage won't do anything as you can't take it back until the finance is paid off so the only way he could get the back would be to pay off the outstanding finance in an agreement with your mum. But if she says no he hasn't got a leg to stand on as it's not legally his car.
Oh and no you can't take the car back and would have to pay off any outstanding finance before you could sell it.

try looking at the paper work, the log book is now the registration of the KEEPER,the owner in the eyes of the law is the person , persons who paid/paying for the vehicle,the car has nothing to do with you, or your ex partner, if your mother gets in touch with the finance company and says fetch the car back they sooner or later will do.But beware,they might put the car into an auction to recover any outstanding monies,if it fails to recover outstand amounts YOUR mother will be lible,if the car is in a reasonable/saleable condition,your mother could get in touch with the finance company, ask them for a settlement figure, have the car assessed , advertise it in the local papers,sell it, pay of finance company job done hope this helps

If the car is in your Mums name and the payments come out of your account then he has NO rights to the car whatsoever. take it back to the dealer with your Mum and get that loser out of your life.

ring them up and explain im sure they will take the car back but you will lose any money already paid
