I was driving along close to vilonia, ar at about 10:45 pm. I had a phone call so i muted my stereo system and was talking on the phone for about 10 mins. I came into vilonia and seen a state trooper car on the left and two cops on the right at a gas station. I reached over and unmuted my stereo, which was loud. I quickly hit the mute button again, and turned my sub volume down and then turned it back on so it would be at a normal level. It was only loud for about 1 or 2 seconds. About a mile down the road a cop pulled me over and told me I was getting a ticket for disorderly conduct. He said if he could here me before he could see me then it was to loud. I looked up the code for disorderly conduct, and i don't believe he that can go towards what i was doing. I'm going to fight the ticket, and was wondering if anyone knew any information that could help me. Thanks.

Disorderly Conduct states "a) A person commits the offense of disorderly conduct if, with the purpose to cause public inconvenience, annoyance, or alarm or recklessly creating a risk of public inconvenience, annoyance, or alarm, he or she:" I had no intentions, and no one complained. Plus the cop had no way of measuring it. A motorcycle would have been louder and i'm sure they dont get tickets. see where i'm going.

The ticket is $155, but that has court fee included. If i pay it it'll be the same as if i went to court. And i think the cop just thought i was some out of town college kid that was to dumb to realize i could fight and win"hopefully" lol

Umm no. I bought this for competition. I Do not go around playing it in town as you must be thinking i do. So you need to stop your stereotyping. And to say i had intentions of "annoying hundreds of people" is on what knowledge? You should not put your words where you have no idea what you are talking about.

First you need to find out "who was offended by the loud noise" The elements of disorderly conduct is that, it has to be Intentionally or knowingly ...and causing immediate breach of peace.

I see your mistake by unmuting your stereo, but I applaud the police for enforcing the disorderly conduct statute.

I know that you won't agree, but you must have known BEFORE you unmuted it that it had already been turned up loudly. Obviously, you were playing it loud before you entered the town or it wouldn't have been turned up.

Most towns are now adding addendums to disorderly conduct ordinances that specifically describe what is too loud, and this is one description of the stereo being too loud. (hearing you first).

Take it like a man and pay the fine, and learn something from it.

I don't believe there is ANY reason a car stereo needs to be as loud as they are today. Most likely, you wouldn't be able to hear an emergency vehicle if you had to.

How much is the ticket? It would probably be better just to pay it. I wouldn't even go to court. On these kind of low level tickets, you don't have a prayer. It's the cops word against yours, and I have had a judge tell me to my face that it didn't matter what I said or what evidence I had, If the cops says I did it, he was going to uphold the ticket. Small towns are even worse! Save yourself the headache and the ulcer and just pay the ticket and remember to avoid Vilonia!

Disorderly Conduct means exactly what it says... If the cops think it was disorderly, you're pretty much screwed cause i am sure the judge will agree.

I've been to vilonia before, they are just waiting for people like you to drive through. I would fight it because if you could see them then they could see you. It is just a money scam anyway. You probably won't win but I would make them take me to a jury trial because they don't want to speed money on that. Good luck
