my divorce decree clearly states that I recieve my pension and my 401k. I think my ex is having buyers remorse. ( the "passion" of her lover must be wearing off!!) She now is complaining and saying she now has changed her mind and wants it. Can she do it, or will the court just laught at her?

Well, she shouldn't be able to if your divorce is final. But she sounds like a selfish b*tch so she might try. I don't think she'll get it though.

I think that once the divorce is done then no sha can't go back and change it unless her attorney files for a motion to vacate the whole dissolution but shes going to spend alot of money doing it and in the end its up to the judge but I think shes going to get laughed out of court.Just in case talk with your attorney.

It probably depends on the state. The best thing to do it to put this under the legal section of yahoo answers. Make sure you state you would like a legal person to answer.

If your divorce is final, she's pretty much SOL but you should let her take you to court anyway so you can watch the judge laugh at her!

I dont see how they can change what she agreed to in the divorce. But, odder things have happened. My opinion is the court will laugh at her. Good luck to you.

I am not too sure, I think you should check with a lawyer. I do not think anyone on Yahoo will be able to answer that giving a complete 100% knowledgeable answer.

I would hope they would laugh at her but it could be possible for her to get it. Maybe for your sake they will not let her.
