Moral realists are those who think that, things should be taken at face value – moral claims do purport to report facts and are true if they get the facts right. Moreover, they hold, at least some moral claims actually are true.

I think moral realists will tend to strictly interpret the constitution. They will see that the facts state that Treason is a capital crime, and so believe that capital punishment is constitutional. A moral relativist will find another doctrine like cruel punishment and try to apply it to the death penalty.
