My passenger was complaining of her right shoulder that night. Now she says it is her left shoulder and she has to have surgery! Befor the accident she always complained of her left shoulder. Even went to the doctor for it!! How can her left shoulder be hurt and not her right? Can she sue me for a shoulder that was already hurt?

Yes she can and I smell it coming so I hope you are ready. A person can have damage or a previous injury but if more is sustained and you were driving it is possible for her to sue. I'd lawyer up if I were you and find a way to prove that her injury was not to that arm or that the injury was pre-existing and is not any more damaged.

If there is a history of complaint about the shoulder she is complaining about, you can prove that it was a pre-existing condition.
However, the accident might have created more damage, maybe?
That is too bad that she doesn't think you guys can handle it as friends!

No - try to get proof that she went to the doctors about this before the accident. You know who to never give a ride again.

yes she can, you will have to prove that the car wreck did not do more damage to it. Even if it was damaged, if wreck did more damage you will be liable.

Also it is commom for injuries to appear the next day,
