You can collect if a DNA test proves positively that the person you are asking support from is, in fact, the biological father of that child. If he is not, you are not going to get child support from that man. It's wise to get a DNA sample and test on both your child and from the man you think is his father. A good sample is semen or blood, preserved by freezing. Remember "Monica's dress" ?

Do you have a lawyer or a social worker? They could both tell you, but I'm thinking you can be legally separated. I think this just involves filing some papers.
