since he was born 4 months ago he has had my last name since father is not on birth cert. we are going to court this month, he is having a paternity test. will the court make me give baby father's name?

no you can leave the babys name as is

No they won't make you change the baby's name. My niece had a baby out of wedlock last year and they made the Dad put in writing that it was OK that she give the child his last name. There are also some parents who give their child a last name different than either of theirs.

No they can not make you give your son the father's last name. That has to be a mutual agreement between the 2 of you.

No, absolutely not...you will not have to change the name. In fact in order to give the baby his last name, he would have to sign a consent form. At this point, you would also have to go to court and petition for a name change to have the baby's name changed to his, you have nothing to worry about hnn!

Nope not at all.. I gave my daughter her fathers last name and I didn't put him on the birth certificate

No. I gave my daughter a random last name. Not mine, nor the fathers. He pays child support, but she still has the same last name!
