My cousin has been working for this guy,, collecting rent for some appartments. He would collect the cash, and then deposit into his accout for him. Sometimes though if the boss was in town, he would hand it to him instead.
This guy then hired an accountant/assistant who then saw that the deposit reciepts did not add up to the amount that it should have, so now he is sueing him for atleast 1k euro (Irish court) i honestly think they have no chance, because of bad bookkeeping and the fact that my cousin was 15 whhen he started (now17) but they think thry have a chance. Im no expert so could you shed some light on this? I know he didnt steal. Who would be stupid enough to steal over 1k from a buisnessman? (oh yeah the boss guyis a total freak, has millions, but drives a 10year old car and never changes clothes.
Please help aas he is really stressing over it. I would freak out if someone threatened me like that.

they dont have a chance becasue he was just a kid and the boss should have said it not the accountent

An auditor or accountant can easily proof if there is any money missing. He might ask the renters for proof of payment and is checking the bank accounts what has been deposited. Sounds like your cousin didn't ask for a receipt from his boss when he gave him the cash directly. Your cousin should ask his boss in a professional manner, what he did with the money he has received in cash. Ask him, if he deposited the cash or put into his own pocket. Maybe the bosse's light bulb will shed some light on it.

If your cousin did not steal any money, then the best thing you can do is to trace all the money he has collected. Get bank deposit receipts and rent receipts. Try to show that the amount of money deposited does not allow for your cousin to have been able to steal that one thousand Euros.

The landlord can show that your cousin normally deposited the cash directly into the bank. He can also show that some deposits are missing. This shifts the burden of proof to your cousin to show why the deposits are missing. Can you cousin prove he gave the cash to the landlord? Did he get receipts? Were their witnesses? If your cousin can't show evidence that he gave the landlord the cash, he may lose. Age is not a defense.

Receipts, receipts, receipts....Getting into business requires good bookkeeping. If you didn't you could be f****ed. The burden of proof is on you! To take this to court, you must understand that age is not necessarily a plus, because anyone who enters into a contract has to know the downside. Please speak with a solicitor to determine your status.

The guy needs legit proof. ex...maybe video of him taking pocketing money? If I was your cousin, i would just calm down about it. If he knows he didnt do it, then he should just chill out and you wont have a problem

well they have to prove it. your cousin should take everything that he has in regards to this to court with him and if nothing else talk to a lawyer and see what they think
