My wife left and filed for emergency custody of the children, how can she do this as and get it granted as I have no record of problems with my children. I also had no chance to be heard in the court before it was granted.

Get a good female family law lawyer. As a woman the police andthe courts will err on her side everytime. Make sure you are on good terms with your kids teachers and day care providers. If legal in your state record every conversation you have with your wife and assume she is recording you. Assume that any time you have a conversation with anyone remotely frendly with your wife, that any thing you say will be used against you.

I think there are some hysterical answers here. I don't think she is going to 'go for your throat'. I don't think you are going to have the 'wife from hell' and I think those are irresponsible answers.

It seems that emergency custody is just who is going to have the kids until proper custody agreements are made in a court of law. Someone has to have the kids until you start sharing them. Having said that, it is a good idea to keep a journal or diary of anything you think might be relevant from now on - anything to do with your contact with your wife, or with your kids, or lawyers, or anything like that.

I hope it works out and you both see your kids. Please remember that if you are mean about your wife where your kids can hear you, you are only hurting the children and they will remember it.

What can I say.... I'm sorry and sometimes I'm ashamed to be part of the female species... Snakes with T*TS.

My husband has and is going through some c r a p p y stuff with his x as far the children are concerned...
When they know they have nothing left but the kids, they use them, its dispicable!

I genuinely feel for what your children are and will no doubt go through in the future, just keep telling them how much you love them, and though you may not see them all the time, you're always thinking about them...

This is only the beginning of the wife from hell. You should have acted first and taken them away from her. Ask for full custody and chaperoned visitation. She is a danger to your children. Get an lawyer that is for "father's rights" no other lawyer will do.

Because she can and it's the law. If you want join custody then discuss that with your lawyer for the court date. If you want to take custody from her, then you have to prove that it's in the children's best interest to be with you.

You need to talk to your lawyer.

You need to back to the court house, and file some paperwork. It cost money to file for custody, but that is what you need to do.

been there done that dude get smart quick she's going for your throat and you had better be prepared to go for her's. get a tape recorder and tape all your call's get a detective if you lawyer doe'snt have one working for you already and prepare to rumble.
because it's going to be nasty. and even if you get your children
she will make your life hell. because in most case's you have the burden of proof. and this is a civil action lott's of luck and God be with you.
