We have lived in our apartment now since February of 2006. The whole building has pretty much become new neighbors. All of them are much better than the ones we had, except, of course, the jerk-offs above us that pplay their bass all hours of the night. The day they moved in they asked us if we knew how to get some illegal substance for them, which was a bad sign to us right off the bat. We told them we have a premature child and don't have anything to do with that kind of stuff. Now they play this horrible music with the same, monontonous tone over and over again. I took my screaming baby up there after 3 hours of the stuff the other day and knocked on their door and rang their doorbell and they didn't come to the door but I could hear them walking around our bedroom ceiling, so I knew they were home. Mind you, my baby is on a heart and respiratory monitor and is preemie. The office pretty much won't do **** and I am going to lose my **** soon. How do I keep myself out of jail????????

Uhh call the cops. File a noise complaint and keep filing them until they stop. Thats the only way anything will get done.

There is a clause in your lease that says you are entitled to the "quiet enjoyment" of your apartment, which means people like your upstairs neighbors from hell cannot pull the crap they are pulling on people like you.

Especially since you have a baby, I would in no way make an effort to confront these lunatics again. Even though they didn't answer their door, they most likely saw that it was you at their door that day. So, if you call the police, they will most likely know it was you that called.

No matter what your leasing office says, they have to honor the parts of the lease that apply to them - which includes your right to "quiet enjoyment" of your apartment. If another tenant is preventing you from doing that, it is the responsibility of your leasing office to notify this tenant. Enough notifications can eventually get the tenant evicted.

I've dealt with leasing office's in the past - and they will try to throw a problem back onto you if they can. Don't let them get away with it. Let them know you understand the "quiet enjoyment" clause - and that they need to enforce it unless they want you to take legal action.

I'm so sorry you're going through this. Neighbors such as the ones you're dealing with really can make your life hell, but things have a way of working themselves out - even when we can't see a way out at the time. Just stay on your leasing office. Do not let up on them. And keep documentation of when your neighbors are making unreasonable noise - which is against the terms of their lease, even during daylight hours. Just because it's the daytime, doesn't give a neighbor carte blanche to act like a complete lunatic.

The office should be doing something! That's their job!
Definitely call in the police for disturbing the peace. If you really suspect they have drugs, tell an officer about the incident when they first moved in. Make note of any smells that seem a little off coming from their place, most likely someone in the building knows what some of them are or could be.
If all else fails, move. Check over your lease and see if there's a clause about what the people in charge of the building should be doing. They very well may be in violation of your lease, in which case, you are able to get out of it. If not, and this sounds mean, suck it up until the lease ends and then get the hell outta dodge.

You need to get out. Find a new place. You can not win. Never rent or own a place where someone lives above you again. You can not win. Pack and leave. If the landlord won't do anything after you requested then your deposit is a moot point. Don't pay another penny. Find another place and go.

Find out from your local police station the cut off time for noise abatement, then report the neighbors. I had this problem with neighbors who lived below me about 5 years ago. Wrote the management company letters which they did not respond to. Kept copies. Finally left. The management company tried to put me on the credit reporting Co's bad books, finally got it sorted out when I could produce documentation to prove my case.
So basically keep records, always send mail certified, and keep your cool.

#1 You speak to the manager of the building. It is their job to approach the noisy neighbors.
#2 You need to be actively seeking a place to move to. Keep in mind that you need a place where you won't have upstairs neighbors.

all cities have noise ordinances. wait until one minute past that time, then call the police. do this every single night. i guarantee you the police will inform the landlord after the 3rd time and the problem will be solved, more than likely by them getting evicted. do not take matters into your own hands. selfish people like them often seek revenge against individuals.

A complaint to the police for breach of the peace will get them a visit from the local coppers who will tell them to stfu or be arrested. End of story.

cant you like be really noisy very early, i assume they are late at getting up, whatever they do to piss you off you do it to them make a diary this could help when you go to court get there phone number before you fall out with them you can call them early send pizzas all sorts be creative and knowledge is power, film them take pics.
