Is this settlement the result of litigation or pending litigation?

In any event ... hell yes! Declare it or risk getting screwed later!

The taxes are usually already removed..

In 2003 I got a settlement from U.S. Depart of Labor ( USDOL)
when they sued my employer on behalf of employees who were not paid for some overtime hours.
I was entitled to $900.00 from USDOL but taxes were taken out. i got $792 check.

IM involved in a discrimination lawsuit, the government represents me. If the suit is settled/ won .. i get to keep 100% the goverment lawyers dont take 30% like private lawyers do....but...i will need to pay taxes on any money won.

Here's one principle for life:

The government never gives you anything without getting more in return. Any kind of money will eventually end up taxed. Declare it or you'll have tanks and cops with machine guns taring down your house before you know it.
