what diffines goth. is it a dress code or attitude?

First off, it depends on whether or not they're a real goth or a Hot Topic goth. Hot Topic goths (or pseudo-goths) have the goth look, and to an extent try and do the attitude. But real goths are not goths because of how they look or act, but who they are. They see all the evil and pain in the world and accept it, thus making life a bit depressing. Thus, the stereotype that they're never happy. But they can be.
As for your specific question, it depends on your definition of happy. If you mean happy-go-lucky, "wow, what a wonderful world" kind of happy, than no. Goths are realists and they're not happy without a reason. But yes, goths can have happy periods, just like everyone else. Being with their friends, reading a good book, or listening to music makes them happy.

I knew a lot of goth kids in college, and generally they were all quite happy people. I think it's more an outlook on life than anything else: Finding beauty and humor in things most would consider too dark.

Yes, I think goth is just the way I dress. If everyone wore kacky shorts and plaid t-shirts that would be boring.

goth is more of a rebelion statement than anything else, in my experiance as a police officer , most goth youth i've met are sad, depressed, have social skill and or mental problems as well as they have feelings of persicution and not fitting in , being excluded for being different.
