She has every right to be in the house, she owns part of it
He is breaking the law, and being cruel to his mum, which in it's self is Neglect.
Help the Aged might be able to help and some charites can do things to help resolve it with involving solictiors and such

I am not a lawyer, but it is pretty safe to say that she has a right to be in the house just as much as he does. She cannot force him to be her care giver, but she can bring charges against him if he harmed her or possibly neglected her. If she is 94, then her son must be in his 70s. He may have some health problems as well. Maybe he is no longer able to care for her and does not know how to approach this problem correctly. I wonder if a family advocate or moderator (sort of like a social worker/lawyer) would be able to help in this case. They would interview both parties objectively and try to find suitable resolution. They are much cheaper than hiring a lawyer -but if moderator is not able to help then lawyer might. Moderators are often used instead of lawyers to help couples reach resolutions during divorce. This situation resembles divorce in some ways.

If they are joint owners then the law would say that they both have a "right to occupy" which means that they cant throw each other out. She should go to the police. They may even ask the son to leave if they think that he has been mistreating her.

You need advice on this, she would'nt be safe if she were to return to that total tosser, stay with relatives and call the police, she has as much right's as the son so also see a solicitor.

She should consult a personal law attorney. If she has signed anything, the attorney may be necessary to get any contractual agreements (such as the durable power of attorney medical, or any power of attorney) nullified or changed legally.

hes a tosser that needs someone to give him a good kicking, if he dident want his mujm there he should have baught her out and maybe got into into a residential home where she could get all the help and care that the poor woman deservs i really feel for her and i would never dream of treating my mum like that

i'd go to the police but if they made him take her back- would she be safe- and looked after properly- what a horrible man- get a good lawyer! I wish her all the best

get help fast...if she can buy him out she should do that...if not she can ask him to buy her out. then she could get into a nice residential home that will look after her properly and she will be safe there
