My nursing job requires mandatory overtime, usually on a weekly basis. I want to continue to work without being punished at work for refusing to work extra hours. How can I legally do so? Are there any websites that address this topic? Short of taking the FMLA leave. I need to keep my job,but my child needs his mother too. Please give me any info you have on this subject. I work for a union organization if this helps.

Get a job that doesn't require mandatory overtime and meets your personal needs. Your present employer cannot shift your time to other employees. It is not fair to them. How would you like it if you got stuck with someone else's overtime because he or she received a special favor for a "good" reason. Everybody has a life and problems and good reasons for getting special treatment.

Or you might check to see if you can give your OT to someone who wants extra hours and pay. Maybe they'll let you slack off if you can talk someone else into doing your work.

I'd say research the companys regulations on overtime, see if that provides any info to help, if not, I'd contact my union rep and see what they can find out, maybe they know something I dont. Also look at the Americans with Disabilities Act--might be something in there too. Good Luck

The Family Medcal Leave Act pertains to all employers of 50 or more individuals. The law requires these employers to provide unpaid time off to allow employees to take care of immediate family members if there is no one else to provide their care. Often there is a state law that is in force as well, you should check into that. One would think that your employer or your union would permit your request without the need to take the leave. Maybe if you write a nice letter to your company/union that they could accommodate your request.

check into the fmla or the other one where if they have 14 employees or more if you qualify for it and it isin the company handbook that they comply then they have to w/o u losing ur job. if all else fails and u are not sure contact an attorney and have him look into it for u. i know here in sulphur,la there is no such thing as mandatory overtime it has to be voluntary

If you have access to a union contact your rep. Aside from FMLA, you must have known what you were getting into before signing on to this job ... so the responsibility lies with you. Other than getting a new job, you may have to make other arrangements.
