Check your receipt. If you don't have your receipt, no. If you do and you're within the return period, yes, less a restocking fee.

If its damaged the apple save wont replace it until eventually it has a warrenty, (all ipods initiate with a a million year warrenty, so in case you baught it a lot less then a year in the past, you'd be tremendous)

Well, onlyl if you're within in the time period that the store gives for exchanges. Otherwise, they won't because you bought it at your own risk.
