I see your point, but people don't get abortions when they are 8 months along....
I believe in "pro choice". That might not be for everyone, but there are enough messed up people in this world, by force a person to be a parent when they really don't want to be or can't be.... Nothing is cut and dry, not even this....

My son was born 5 weeks early so he was born in the 8th month. If a baby can live outside the womb, but a person kills the mother before the baby can be born it is certainly killing the baby too. Abortion is something I could never do or advise someone to do because if the birth-mother of my son chose abortion I would not have my beautiful baby boy. That said, I think if a baby is unable to live outside the womb say at 8 weeks not 8 months, I think the argument wrong or not is that it is not considered a baby but just cells growing. I am not saying I agree with that but that is where the line is drawn I guess. I am pro-choice only because I think a woman should have the right to choose. Like I said, I could never do it.

I'm pro choice, for the first 2, 2 and 1/2 months, at this time the baby is basically a ball of cells, and then just kind of a gross looking blob.
Abortions after the first 3 months are not legal (in our state at least) because the baby looks like a baby by then, has a heartbeat, and some features, so yes, yes, yes, that was murder and that woman should burn in hell. (If i know what you're alluding to)

if a woman is attacked when 8 months pregnent and loses the baby then the attacker will be charged with assault on the mother and murder of the baby because at 8 months the baby is capable of living outside the womb

Well what it comes down to is what the statutes in a specific state claim is a human being. Most states, though not all, claim that once a fetus can survive, without significant measures, outside of the mother's womb, then it is indeed a human. It doesn't matter whether I agree or not (and I do not agree). That's what the statute says. I suggest you research the statute in your state. If you don't like their definition, perhaps you should send a POM to your congress people letting them know you don't like it and WHY you don't like it.

Of course it's fair to try the agressor for assault--whether the woman is pregnant or not, she was attacked!
Now, murder is another question. If that's what you mean, it's a lot fuzzier. There is no boundary between life/not life, so any rule we make about life before birth is pretty arbitrary.

That assault acted like an abortion....eventhough it wasn't intentional.
When abortions are made illegal, this specifc situation would be considered, and the assault would be considered manslaughter or murder...

Now that is definitely a "late term" abortion. Be that as it may, your question is a good one. Let's assume it's only three months:
Most people will argue that, because it didn't have the mother's consent, it is murder.
With the mother's consent, it is "ProChoice."

well ,they r wrong, as long as u hear a heart beat anything is alive. Either in or out of womb. And u can be charged in most state for hurting someone carring a baby, or even causing the death of the baby> It is murder
