If the fence goes right down the property line both property owners must come to an agreement. If the fence is on one property or the other it is the property owners fence and he or she can do whatever they want. However, if the fence that belongs to your neighbor is a problem and it presents a legal matter they must insure it is "up to code". If you have questions on that part you can get with your city code folks and they will be happy to assist.

Depends on where the fence is in regards to the property line.
If it's entirely on your property then of course it's your expense, but a good neighbor will offer to split cost of repairs.
In some areas the local building code specifies that a fence can't be placed right on the property line, it must be a specified distance from the property line.

The fence belongs to whomever installed it or had it installed. I have seen some areas where neighbors will install their own fence on each side. Did your neighbors install the fence? Or maybe a previous owner of yours or their house? If neither installed the old fence, then you need to decide on replacement between the two of you.

great question but one i posed to a city inspector he said they would have to have both properties surveyed and then the property lines clearly marked and then who ever has the most of the fence on their property is responsible but if the fence travels thru two or more propertys then its up to the individual owners to terms on a single course of action...
