You are entitled to recovery the damages you suffered. You will get what the judge decides, should you go that direction. Or what the insurance decides, should you go in that direction. By the way, you can sue in small claims court to recover your deductible, if the other person was 100% at fault. But if you just slam your brakes on for no reason other than to cause an accident, you will likely lose.
This is not "payday" honey. This is "damages". That is all you will collect.

We settled for 8,000 but the lawyer got the biggest part of it. After the hosp and doctors are paid off there really isnt much left?
Also depends on how bad you was hurt?

It depends. If the bumper hasn't deformed, you can't get whiplash money. I got hit from behind and I got $500 to repaint my bumper.
If your trying to milk it, you're just driving up everybody's insurance costs.
