when a truck, driving in the wrong direction on Meadowbrook Highway on Long Island, crashed into it killing both the limo driver and the 7 year old flower girl, decapitating her. Her mother was seen cradling her head on the side of the road. The driver of the truck was drunk and fell unconscious after the accident. He admitted to not caring about the outcome of his actions. He was from out of state, didn't have a license and had been arrested in his home state twice for driving drunk in the wrong direction on the highway and once for driving drunk.

His mother says "It was just an accident".

This is a true story and hit home for everyone here. The trial just started. What do you think should happen to this guy?

Dan, you probably know this case very well then. I cried at work when I read about it, especially the part about the mom cradling her childs head. As a mother I couldn't conceive.

The reason I posted this question is while I feel this guy should be punished horribly, I am very torn on the issue of the death penalty. But if anyone was to get it, I would definitely offer him up as the first candidate.

life imprisonment for murder in the first degree, under the rubric "depraved heart indiffernece" to suffice as sufficient intent for the charge.

If the facts are exactly as you state them, and, I were on the judge. I would sentence him to life in prison without the possibility of parole. Of course, that is what our law provides. If he was convicted twice for drunk driving, did not have a license and said he did not care about the outcome...if it happened in a country that I ruled, he would be executed. He has a track record, doesn't care about anything or anyone, caused a death, why should the taxpayers even be put through the expense of supporting him for the rest of his life. In fact, I wouldn't even spend the money on the drugs to kill him, I would lock him in a room with the girls family and family members of other people he hurt. An eye for an eye...

He should be prosecuted for criminally negligent homicide. Seeing as how he was drunk and unrepentant, he'll probably get the max, which is unfortunately only two years.

I don't think "depraved heart indifference" would apply, as depraved indifference shows that conduct has an imminently dangerous grave risk of death, as opposed to a "substantial" (lesser) risk of death. Driving drunk isn't imminent.

However, I'm not a lawyer, and the above guy is, so there ya go.

He should be jailed for vehicular manslaughter, drunk driving and driving while on the revoked list. He should probably serve 15 to 20 years for this. The mother sounds as if she's in denial. I think there is enough legal precedent in similar cases in N.Y. for this individual to be prosecuted to the fullest extent of the law..

That is very sad,I hope the families of those killed can get some closure.He should get life as far as I'm concerned.His acts were willful and he showed no remorse.The other cons in jail don't like child killers,he will have a very hard life.

This is far to commom in our society, and the minor things that happened to him on his last convictions is part of the problem,

But 20 years to life in prison would be what I would look for.

Seems like a redundant question. He should and will be tried and sentenced like everyone else, unless this is the world's first trial by Yahoo Answers.

Why even bother. he's a danger hazard out on the street, and the stupid cops and judges won't realize it until it is truly to late.

He should meet his maker and face judgment. I think they should charge him with murder. He should also be given the death penalty.

frightening that one feels compelled to ask such a question....
What I THINK should happen to him and what LEGALLY can happen are two different things....In my OPINION: death penalty for murder.
What WILL happen more than likely a slap on the wrist...after all he is sick.....blah....blah....blah....
