So my freind and I went on a vacation. He was driving my mustang, while he was backing out, I warned him of the rocks in the back... instead of listening, he yelled out and say "its five miles away" then he crashed.. leaving my rear end bumper dented and scratched, what should I do? Insurance cant pay for it as it does not exceed my deductible.

Of course it is his fault. He was driving and in control of the vehicle. Now, if he were any kind of man, and any kind of friend, he would at least offer to pay as much as he can.

You'd loose in court thoough. YOU are the owner of the car and YOU allowed someone else to drive it. YOU then take on the risk. So you are hosed man. Get the car fixed and get a better class of friend.

In a way its both of your fault. Its yours for letting him drive it in the 1st place and his for being an *** and not listening. BUt if he was a true friend being he was the one who wrecked it he would at least offer to help pay for some of the damage!!

I agree with both sides, You shouldnt have let him drive your car unless you were prepared for situations like this, But since he actually was the one who messed up, and should be a responsible & true friend, he should have offered to help.
So i propose that you offer to split the cost with him. half is better than nothing! And if he refuses that offer, then yes take him to court, for he would have proven himself to be a selfish and pathetic friend.

He was obviously at fault. It is probably a good thing that your insurance didn't get involved. You will see how much of a "guy" your friend is in how he handles this. If he doesn't at least offer to split the cost, he would be my former friend. He should offer to do more, in my opinion.

It's totally his fault and if you went to court, he would pay for the whole thing. In the name of friendship, offer to pay half (if you can.) If he's not willing to pay for even half of the damage, then he's a crappy friend and you should take him to small claims court.

Try to fight it and all you will get is a life with one less friend. It is his fault as the driver how ever eve if you took him to court there is nothing you can do because you let him drive..sorry

He should offer to pay for the damages, since he was driving it and damaged it.

If he won't pay the damages, you could take him to small court. And drop him as a friend.

you are at fault...you let an uninsured driver drive your car....you have to pay the deductible anyway but if you tell your insurance company , hi high your rates will fly, to the sky.

Just pay for the repairs. It isn't worth fighting over money with your friend.
