okay we had a dna test , father didnt sign birth certificate, child has mothers last name. mother and father are married.
father is homeless- living with his mom, no stable job no car.
mother has partly stable job she works 4 days a week, has 2 cars, has own house.
who would get custody? my husband is mentally abusive, curses at my 2 y/o son. i want a restraining order monday
do i get to keep my son? he is really mean to him and gets mad if my son pukes. its sad
please help what do i do?

Get your self a lawyer if you want to protect your son, you need to have a lawyer. If nothing is set up for visitation right now you do not have to send him with his father. Also too if you feel your child is in danger you need to protect him as his mother, and not send him with his father. Good Luck

Well the dna test will hold in court. 9 time out of 10 the mother gets custody of the child. get proof that the father is verbaly abusive. if the father comes around and cause any trouble this weekend call the cops for domestic and trust me that is enough to show the judge that he's an ***. if your short on cash got to mothers rights.com there is all the stuff you need. hes' a dead beat. Not all men are fathers. Or here is an idea call social servies and they can help you get the ball rolling as well.

The judge decides, but if all your info is correct and not added a little bit to, you will.
The judge will always side with the child, not the parents. If he thought your kid would be better with his father, then he would go there. Don't worry, it is rarely a child gores to the father.
I have custody, but my ex is so hooked on drugs that it was a no brainer.

i would talk to someone a lawyer or other trusted person who deals with this. what he is doing is considered abuse and should not be ignored. in many cases, the abuse will not go away, it will only continue to get worse. it many cases, parental rights can be severed, giving the fit parent custody. it shouldnt be that hard to prove, but act fast before your son has to be pay for it..in the worst way.

i would suggest to get your self a layer and show as much proof as possible as to how your x is with your son and the judge will see its not in your son's best interest to be with him there for living you to be awarded custody .

it depends on the state you live in... you need to talk to a lawyer in your state and find out, in my state they no longer give joint custody.... most of the time (80% of it) the mom gets custody.....
