Im about to be married and move to England for two years. I have a five year old daughter and am worried her father cant stop me from going on with my life. He is in prison right now and will be out in a year or so. He is not on the birth certificate and he has never paid child support. The reason he is in prison is for felony drug charges.I just have heard that legally he cant keep me from taking her to another country which means he has control of my life and where i can take my child.

You should get a court order which allows you to go. You don't want to be accused to parental alienation, especially since he's getting out; however, his visits may be limited due to his record. It depends, also, on whether or not she sees him in prison.

It sounds like this is a really complicated matter that would require the services of a good family court lawyer. I would think that a biological father that has not had any responsibility in raising a child would not likely fight you taking her somewhere. You did not mention if the father had any kind of relationship with your child. That should be ocnsidered as well. Does he have legal rights, or did he sign them over? Do you think he owuld sign them over now that you marrying someone else so that the step father coudl adopt? Good luck!

I also have a child whose father is not on his birth certificate, and is currently incarcerated. I live in a foreign country right now and as long as your childs birth certificate does not list the fathers name, you do not need his permission to take your daughter out of the country..... You only would need his permission if he was listed as the father. You dont even have to tell him you are going. The only thing he could do is when he gets out, he could try to establish parental rights and prove he is the father with dna testing, but even then due to his criminal background he probably wouldnt be very successfull in the court system...... Go to court. It will be easier there.
