Well, here is the good legal argument to overturn Roe v Wade. The decision violated the Constitution.
1. There is no mention of abortion in the Constitution and therefore, the Supreme Court has no authority to address it.
2. They invented a right to privacy that is not in the Constitution.
3. The matter is for the legislature. They make the laws. The Courts job is to see if it specifically contradicts the Constitution. There are too many activist judges.
4. The 10th Amendment specifically states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people. This means that if the Constitution does not give the right of the federal government to rule on a matter, it is reserved for the states.
The correct decision by the Supreme Court will be that the decision is flawed. All abortion matters are reserved for each state legislature. Abortion will be made illegal in many states. There will be some states that will not make it illegal. The decision is based solely on law, not political views. If the Supreme Court rules that all abortion is illegal, I will have a huge problem with that. They do not have that authority. I am pro life, but understand how the Constitution works.
Feminazis will politicize this issue with a lot of emotion. They make me sick. The religious right will do the same.
To clarify there is a difference between conservative politically and judically. Judical conservatives like Thomas, Scalia, Roberts, and Alito understand my argument and I believe agree with it. This issue will continue to be politicized because the people doing it cannot think nor understand what the real issues are at hand.
