...support payments to the spouse. He has sent in a proposal but she hasn't responded. He says that it will go to family court if she does not accept the proposal. Can it stay in limbo like this indefinitely?

In some states, cases that are not moved along are dismissed.

Either party can mark the case up for a hearing, as you imply, so the delay is by both sides.

I've worked on divorce cases that lasted 2-3 years. A case may be dismissed for inactivity after 6 months (depends on the court), but that doesn't get you divorced - it makes you start over.

In the sate of Kentucky if the person has a lawyer they can expedite the matter by filing a response to any offer made by him with the court. If she does not have a lawyer she should keep all correspondence in written form and counter offer as soon as an offer is submitted to her. She too can file for a hearing in family court and usually if she can show a hardship it will be placed at the top of the docket.

allot depends on the state you live in ...how long they were married ... if children were involved so many different things can drag it on....but no it can not state in limbo indefinitely....the laws (he may have to push it to get to court quicker) normally have a set time before a divorce can become final....also a only so long some one can fight the procedure

If it is a simple matter of being divorced, there are often procedures where you can sever the actual divorce from the rest of the proceedings (ie. support, division of property, etc.) and leave those matters to later date.

Sounds to me more like they may both have either crappy lawyers or very busy ones.

you could resolve this in five minutes........either accept the proposal or go to court. but you women need to complicate things. the woman actually has three choices. accept the money in his proposal........accept the money the judge orders (could be more) do nothing an accept no money.....typical of a woman to do what is stupid.

What kind of lawyers do you have? The lawyers are earning mega bucks. Supeona her or him to court, give all facts to judge and let the court resolved it. Hence, you will be divorced, all finances will be finalized and piece of mind will be yours.
