There are conflicting laws at play here. The Copyright Act and the Digital Milenium Copyright Act (DMCA) are the statutes most at issue. The question is whether your use would be akin to "time shift viewing" - explicitly permitted in the Supreme Court's Betamax ruling, or whether it is a DMCA violation, because of the format in which is was recorded.

Recent rulings in the RIAA cases would lead me to believe that the use is not technically legal, however, provided you never took the material off your drive or shared it online, it's highly unlikely that anyone would a) know or b) complain.

Final word about recording streaming sound is not pronounced yet. It wont be coming a long time. One thing certain is that you cant record streaming content and sell that. Once you hear a song, it gets recorded in hte best hard drive there is - your brain. the difference between the recording that is made in the head and a HDD is only a matter of degree, not of kind. Therefore courts will take a long time coming to a conclusion about it. In the meantime go ahead and hand copies to your friends for private use.

Yes, I believe you do, providing it is only for your own use. It is illegal to download and then sell it to another.
