I hear a lot of people getting a felony record for downloading child porn, but when I was watching a story on John Mark Karr, they said it was only a misdemeanor for him downloading child porn????

It can't be a state thing because downloading child porn is a federal thing (internet crimes are always federal).

The Feds only prosecute child porn cases when there is production and distribution on larger scales because interstate commerce is involved when porn crosses state lines.

If someone had downloaded child porn but no evidence exists for sending it across state lines - the states can handle this as a misdemeanor - more child porn brings felony charges with it.

Recently, the Feds gave 40 years to someone for distributing child porn - even the judge said that the sentence was excessive but he had to follow sentencing guidelines at that time.

Big fat felony.

I turned in a friend's dad because i found kiddie porn on his hard drive. (I was fixing a problem and stumbled on it. Then I called the FBI).

He's spendng the next 15 years in federal prison where he can't sexualize kids anymore. One year for each kid pic he had, the minimum felony sentence.

And it is a misdemeanor if they can't prove it is a kid, but there is a national database with all the evidence they need to pinpoint who that child is, how old they were when they had the picture taken, all the way down to who took it. Investigators said that they can prove 9 out of 10 pictures as felonies because its the same 200,000 pictures circulating worldwide.

It sickens me, when I think about how children are thrown into the adult world of porn. Adults can decide rather or not they want to engage in the world of porn, children can't. I don't know if downloading child porn is a felony or misdemeanor, but it's wrong, either way. I don't know you're reason for asking this question, but i sure hope you're not downloading child porn yourself. In the Bible, it says if you hurt or mistreat a child, you're better off, putting a millstone around your neck and tossing yourself into the sea. Jesus spoke these words, so you can only imagine the punishment people will get, when judgement day comes.

316000 for felony VS 189000 misdemeanor So I say it's felony!

As long as someone is badly treating a child, I'd say it's a good reason to kill him or at least life sentence of community labor, out of reach of any child.

It depends on the state where the porn was downloaded in. Different states, different rules. However, that just ain't right.

It should be a capital offense. This is the only way we are going to stop these perverts. If someone downloads it, they have either molested a child or they will eventually.
