Both my daughters have my maiden name but I'm planning on getting married and would like us all to have the same surname, I haven't seen my ex husband for nearly two years and do not know where he lives so I'd like to know if I can change their names without his consent. I've tried looking on the net for advice but have found nothing useful.

If your ex is still a legal parent of your children, you won't be able to change their names without his permission. You also won't be able to have them adopted by your new husband unless your ex gives up his parental rights.

It might be possible to have his parental rights terminated by a court if he has had no contact with them for years. If he has paid child support, even if he hasn't seen them, that is considered contact. Since I don't know your state, I can't tell you how long a period of no contact exactly would be required before you could file for abandonment.

Why haven't you seen the ex? Are you hiding his daughters from him? You can't change their names without his consent unless he's been declared legally dead. That happens when no one has seen or heard from him for 7 years.

i assume your daughters are minors .i changed my daughters surname when my husband and i separated , if you or your daughters don't see him he won't be any the wiser will he ? perhaps one day he might try to find you all again and changing their name will make it just alittle more difficult to locate you but it can be done.if he was concerned about consent for anything he would still be ''around '' wouldn't he ?

Check the statutes.

Some places let you use common usage, but you need a five-year paper trail to support it.

You may need to go to the courts to have it changed legally. It is quicker in establishing it, but costs a lot to do so

When they are 12 they can change their name. It's is pretty easy actually.

if you had sons.. i would understand. and not sounding sexist..but your girls will probably marry and change their names anyway. now if they are real young... maybe you want it for continuity..but God forbid what if this relationship falls apart..do you keep changing their names? i think you should wait and see how things go. seriously

have your future husband adopt them..they will automatically change the last names.My husband adopted my daughter and her last name is the same as ours.

i think your new husband would have to adopt them but then you'll have to deal with your ex who if he is like any other guy would be pretty mad
