If the tree was obviously not in good condition and needed to be trimmed or cut down in order to prevent this from happening and you can prove it, then they are responsible.

Was the tree healthy and in sound condition prior to the limb falling? If so, this is considered an act of god. If the tree was in bad condition, the neighbor was responsible for ensuring the tree didn't need care so that it would not hurt other people's property. There is a caveat to this, however. If the limb was overhanging your property before it feel, it was your responsibility. You ahd the right and requirement to trim the limbs that overhung your side of the property line.
I'd turn this in to my insurance agent, if the repairs are costly enough, and let them work out getting payment from the neighbor and his insurance, if applicable.

Your neighbor is responsible if you were parked on your own property or in an area where you normally parked. His homeowner's insurance should cover you, as well as your auto insurance (ask your agent).
If the car has less damage than the deductible of either policy, ask your neighbor to pay for the damages personally so that neither of you need to make a claim.

unless he was out there with a chain saw cutting the tree limb, no one. It would be an act of God and covered on both or one of your home owners insurance.

Its your neighbors tree so its their responsibility - if you have a good relationship with them talk to them however if you dont have a good relationship with them talk to your insurance company they will sort it out with your neighbors if neither of you have insurance its called bad luck

i was once told if my tree fell on to my neighbors house they were responsible for it .unless befor hand they told me they were concern about the tree falling

I presume that it was caused by bad weather, well then it's definetly called "an act of God", go to your insurance company & see what they say... It just reminds me of a film I seen with "Billy Connolly" It was called "The man who sued God" where he actually goes & sues the catholic church, because they represent God.... it depends how well you get on with your neighbours , you could sue them for bad maintenence of the tree but not if you like them unless they say sure ive got insurance they'll pay
