my ex has never requested the back childsupport because they have alot of money and both kids are 20 and over. Someone told me they thought the children themselves could signoff,but I can't find an answer when I looked it up and the childsupport agency wouldn't tell me over the phone.

I've had a lot of expierence on this...beleive me.

I had several battles with my ex over child support. You are obligated to pay child support until the child is 18. If there is back support owed and your ex never goes after it...the child has until their 21st birthday to file a law suit in regards to getting back support.

After the 21st b-day...no measures can be taken to get back support.

Children cannot sign off on past child support. This is the responsibility of the noncostodial parent and it is due the custodial parent. I know there are other variations of child support besides custodial and noncustodial. The money is owed the other parent for the cost of bringing up the child - insurance, food, clothing, medical co pays, mediciation, school fees for trips and other things... This money doesn't go towards the child - it goes for the bringing up of the child.

You should have been paying it right along - straight up - don't give no excuses about the other parent having so much money. What a bunch of crock. Sure, sure, this is a good way to make yourself look better for not paying up - but do you really and truly think anyone here buys that load?

Pay up and be a responsible adult and own up to your responsibility instead of putting your kids in the scene trying to sign off for you - what kind of example are you anyway?

If you don't get the answer over the phone, go there in person, Also if the support was court ordered, it has to go back through court! I doubt if the kids can sign such a thing!

i dont think they can . in louisiana if a parent owes back c.s. they have to pay and will owe until they do no matter what. even if they sighn all parental rights away they are still legally obligated to pay c.s. until the child reaches 18 or if in college, graduates.
