I had an employee who worked in my company for about 8 years. Over the past year or so, he really started screwing up and I cought him making many mistakes. The other day, he said that he could not take the stress anymore and quit. I had him sign a letter of resignation. Can he collect unemployment?

I never liked this employee and have had problems with him off and on for the full time he was with us. He made threats to us when he left that this was going to cost our company a lot of money. But he quit and signed a resignation letter.

This is a guy covered with tatoos, does not get along with other employees, does not like to follow orders, does not come to work on time, and sometimes does not come to work at all, sometimes without calling. Would you hire him?

You can challenge it. He probably found another job so I wouldn't worry about it. If he worked for you for 8 years and you are that stressful to work for, might I suggest letting him have it. He can only collect for six months. Isn't that cheaper than continuing to pay him to make mistakes for your company for another eight years??? Don't take it personally. He's better off on unemployment than returning to the office with a semi automatic and empty bottle of vodka. Concentrate on replacing him with someone who can handle stress a little better.

Not in Texas, at least under normal circumstances. I don't know about your state's laws.

So, do you want him to be able to collect? 8 years is a long time to remain with one company. Must be something going awry in his personal life, eh? Might a personal call from you to his home be in order?

In california the answer is no. You cannot collect if you quit. If he was smart he would have tried to go out on stress leave since thats the reason he quit but too late.

I've lived in 4 states and you can't collect unemployment if you quit your job in any of them: Michigan, Wisconsin, New Jersey or Pennsylvania.

We do not hjave such benefits in our country. We all needs to work for a living, and the government comes in temporarily only if you really cannot make ends meet. I live in Singapore.

He'll only get Unemployment benefit, if thru no fault of his own, he loses his job, if he's sacked or if he's made redundant.
But he'll get benefits, income support automatically, if he has dependents.

I'm pretty sure he has to have a letter of separation, and then there is a waiting period.
Check with your local social security authority for confirmation.

pretty certain he has to wait for a set period of time before he can collect...something like 4 - 6 weeks

I really don't think he can. It was his choice to leave your company under his own free will. If he does try to collect, I would definitly fight it.
