-the wife is unemployed
-the husband makes approx. $34hr
-they live in an apartment
-have one vehicle(in which, he alone is on the car title and doesn't allow her to drive it and it was obtained during the marriage)
-they share two children in common and he has raised her 12yr. old since the age of two years old;
Does a lawyer obtain his fees from the husband in court?

You explain to your proposed lawyer what the husband's (and implicitly the marital community's) assets are, whether any are community property assets (i.e., if you live in a non-CP state but once lived in a CP state) and he will take it from there.

The Court will order payment of your legal fees.

Half of everything is hers, during the marriage (and likely after), so I assume she has access to a joint checking account? If not, she can always sell some of their furnature and personal possessions, if he won't front for her attorney fees. Most divorce lawyers are well versed in this situation, and will work on a contingency basis, and recover their fees after the settlement.

See a lawyer. It is not necessary to have money up front -- funds will become available through the divorce settlement. If you can't drive, take the bus, or walk, but get going. This sort of aggressive behavior too often leads to violence, so get out NOW.

Find a lawyer that does initial consultation for free. Have him/her
file the divorce petition and ask for attorneys fees.

Call around and talk to attorneys. Find one that will freeze hubby's accounts and put a court order against him that he has to pay all the fees, child support etc.. And don't forget to go after that vehicle.

Get a hold of a lawyer fast. There is a reason he has everything set up the way it is and it is not in your best interest. Call any lawyer and they can tell you what to do.

You can put in the provision for him to pay attorney fees as part of divorce settlement.
