been 13yrs since drug pos. None since, checking 'cause he's good person well liked and belives he can't get a better job which he deserves and it would be waste of a loyal emplyee. - In California

If the application specifically asks for past felony charges or convictions, then yes. If it's been 13 years, most employers will look past it. If he fails to disclose it and they do a background check, it will show up and he will not get hired.

I would suggest two things:

~ check local state laws for felony time limitations,
~ If it is possible have an attorney request for the records to be expunged. This will take it off the record. The police will still see this but for the public it will no longer show up and he will be able to answer no honestly.

If the employer asks in the application then you must say yes if you cannot expunge the record. Leaving this information out or replying no is cause for immediate dismissal and certainly would prevent him from getting the job if they did a background check.

Check into getting it expunged if it is possible. If you cannot afford an attorney sometime the the local colleges will have groups of pre-law students who will help you for free.

It depends on the state, but normally the standard is that if you were convicted over 10 years ago, you don't have to put it on the application.

Often times the application itself says the time limit - check the fine print.

if he was a minor...no...if he was an adult and did time...yes....if he was an adult, but still in his early 20s' he maybe able to use foolish youth and maybe be OK
