my aunts husbands ex wife with whom he had 4 kids has been put in prison for drugs. The mother had the kids taken away not only for the drugs but for saying she was homeschooling when she wasn't but wouldn't send them to school. Anyway the mother wouldn't tell the state how to find a the father or grandparents so the child has been in 8 foster homes. My aunt and her husband also have the last child that the ex wife had, they have had her since birth. Basically we would like to get her back with family. We are in Western oklahoma and the DHS case is in Arkansas. We would like to know wether we will have to have a lawyer or what we need to do next. I would also like to add that the father and step mom had tried to find the child but we unable to due to the fact that they moved so often. Please advise what should be our next step.

I would like to add that as far as a suitable residence my uncle and his wife just bought a new home and they are both employed. They attend church and haven't been in jail or anything. As far as the child being moved so much I am not sure why because as they have talked with her she seems fine and the people she is with now which just happened to be her mothers sister ( pure coincidence I think) she is doing fine. The person she is with now agrees that she needs to be with her dad.

I would immediately contact the Arkansas DFCS and tell them who you aare and willing to give permanent home to this child. DFCS usually place child with family if they can find but the family has to meet requirements-no drugs, violence and must have employment and a suitable residence-----everything has to work and be clean-for once you contact DFCS they will contact DFCS in your state who will check you out including your residence----all eletricity and appliances you have esp stove, refrigerator and so forth have to work and when they come to your house make it look as inviting and clean as possible. And they require the child to either have own bedroom-bed and dresser that's theirs or if share must be age-appropriate but child has to have own desser and closet space(can share closet)Worked in foster care for many years and feel for this little boy for sounds is having difficulty adjusting to being in foster home and is rebelling by acting out-why hes being moved so much. Eventually if he stays in the system some one will get the bright idea (in DFCS) that he needs a bit more and he'll get placed in therapeutic foster care where usually the family (foster has only 1but no more than 2 foster children while in regular as many as have room for with no trining while in therapeutic required to take training year round to handle issues and help child adjust and deal with feelings. Hopefully it won't come to that. My advice is be s nice as you can and cooperative with DFCS for they now have in their power the fate of this child. Be also prepard that this will go through the Judicial System for a judge has to sign the order placing the child into your home and DFCS will stay involved for awhile for its their resposiblity to make sure all is going ok which is really a good thing for the child. As far as a lawyer if the expense is not that big of a deal get one for he'll have access to records, info on the child that you yourself can't get--if it is but you'll do for the love of the child then first see hpow cooperative DFCS is but again a lawyer can push this issue to go faster for as you know DFCS is swamped with cases and the sooner this child is placed with family the less emotional scars he'll have for everytime that a child is moved(a child that young will always find fault being theirs and they hurt and get angry and being so young unable to deal with such strong emotions so they act out, also foster children sometimes get picked on at school-more anger, fustration and even the kids of the foster family. If it were me I'd contact DFCS but also get a lawyer to make sure all this is done as fast as possible. My heart goes out to the litle boy and will say a special prayer that God send comfort to him and that
this gets resolved quickly with His help
